Storage & Handling of Materials
The Oil Storage Regulations 2001
In England, the storage of oils (except waste mineral oils) is
regulated under the Control of
Pollution (Oil Storage)(England) Regulations 2001. The
regulations apply to industrial, commercial and institutional sites
storing more than 200 litres of oil and private dwellings storing
more than 3,500 litres above ground and including oil stored in
drums. Similar regulations are expected to be introduced in Wales
and Northern Ireland. Further advice can be obtained from your

In England, oil storage containers brought into use since 1
March 2002 and those in locations at significant risk must now
comply with the Oil Storage Regulations.
The Water Environment (Oil Storage) (Scotland) Regulations
2006
The regulations come into force in three stages:
1. New tanks installed after 1st April 2006 had to comply by 1st
October 2006
2. Existing tanks within 10 metres of surface water or 50 metres
of a borehole or well will had to comply by 1st April 2008
3. Remaining existing tanks will have to comply by 1st April
2010
Control of Substances Hazardous To Health (COSHH) Regulations
2002
These regulations are focussed on protection of workers, rather
than environmental protection, although, much of the information
and data collected may be useful when considering compliance with
environmental law. Companies have to protect both employees and
others who may be at risk by complying with the COSHH Regulations
2002.
The main duties for employers contained in COSHH are:
• Assessing the risks associated with the storage, handling
and use of hazardous substances in the workplace
• Preventing or minimising the risks to employees who may be
exposed to hazardous substances arising from a work activity
• Implementing appropriate control measures
• Undertaking monitoring where appropriate
• Providing information and training to employees.
The Health and Safety Executive regulates COSHH. They provide
guidance on their website as well as a tool called COSHH
Essentials.
