Digital Networking terms and conditions

  1. These General Ticket terms and conditions apply to tickets registered for the British Marine Digital Network Event (23rd February 2021 only) (the “Event”) 

    Introduction
     
  2. The organiser of the Event is British Marine Federation (company number 02592536, Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF), its employees and staff (the “Organiser”). 

    Admission
  3. All tickets are subject to availability and may be amended without notice. Tickets must be registered for this Event via the Eventbrite website.  
  4. Visitors will not be allowed admission to the relevant part(s) of the Event without a valid ticket. 
  5. Presentation of a ticket for admission to any part of the Event constitutes acceptance of the terms and conditions upon which the Organiser is prepared to grant entry. 
  6. A ticket is valid for one admission only to the relevant part(s) of the Event between specified times on a given date. 
  7. Tickets containing mistakes cannot be rectified on presentation at the Event or relevant part thereof. 
  8. The maximum amount of tickets that can be registered by one attendee on the Eventbrite website is 10. 
  9. Tickets numbers are limited and are on a first come, first served basis. 
  10. Tickets will be provided in electronic format and sent via email to the email provided by the purchaser during purchase. 
  11. A ticket obtained in contravention of these terms and conditions, or which in the Organiser’s reasonable opinion is being used, or is intended to used, in contravention of these terms and conditions, shall be void. All rights conferred or evidenced by such a ticket shall be nullified. 

    Promotional Tickets
  12. Tickets shall not be used for any promotion, advertising, fundraising, auction, raffle or other similar commercial or non-commercial purpose including, but not limited to, being awarded as a prize (or part of) without the prior written consent of the Organiser. 

    Refunds, Exchange, Transfer or Resale
  13. All tickets remain the property of the Organiser. 
  14. Any replacement of lost, damaged or stolen tickets remains at the discretion of the Organiser. 

    Right to Cancel, Defer, Rearrange or Amend
  15. The Organiser reserves the right to defer, rearrange, amend or cancel the Event in whole or in part at any time without obligation to refund or exchange tickets. 
  16. If for any reason the Organiser cannot offer a visitor any aspect of the Event at the time or date booked, it will endeavour to offer such visitor a suitable alternative time and/or date during the Event, but it will not be obliged to do so. 

    General
  17. Possession of a ticket does not confer any rights (by implication or otherwise) on a visitor to use, alter, copy or otherwise deal with any of the symbols, trademarks, copyright, logos and/or intellectual property appearing on the ticket. 
  18. Visitors may be filmed and/or recorded for broadcast, marketing, Event promotion or security purposes during the Event. 
  19. Ambush marketing is strictly prohibited, and anyone caught carrying out such an activity will be evicted from the Event and potentially be subject to prosecution. 
  20. Visitors must not breach or infringe the rights of any sponsors, suppliers, broadcasters, exhibitors or other parties commercially associated to the Event. 
  21. Visitors must not bring any musical instruments or equipment into the Event venue without the prior written consent of the Organiser and the venue operator. 
  22. Visitors must do nothing which may constitute a breach of the law, cause nuisance or annoyance to other persons in the venue and/or Event or to local residents. Endanger any licence for the sale of alcohol and/or for music or dancing. 
  23. Visitors must comply at all times with any instructions issued by the Organiser of the Event. 
  24. The Organiser reserves the right to change these terms and conditions from time to time. 
  25. Visitors shall ensure that they and their organisations shall commit no acts or omissions, either before, during or after the Event, which may bring the Organiser into disrepute or may damage any of their reputations or is materially adverse to any of their interests. 
  26. Each visitor (and its organisation if such visitor was attending on behalf of such organisation) shall indemnify, defend and hold harmless the Organiser against any losses, liabilities, damages, costs including but not limited to legal fees) and expenses incurred by, or awarded against, the Customer as a result of any breach of these terms and conditions by the visitor (and its organisation if such visitor was attending on behalf of such organisation. 

    Limitation of Liability
  27. Except for any liability for: 
    i. 
    death or personal injury caused by our negligence; or 
    ii. 
    fraud or fraudulent misrepresentation; or 
    iii. 
    any other liability that cannot be excluded or limited by law; 

    the Organiser will not be liable, whether in contract, tort (including but not limited to negligence or breach of statutory duty) for: 

    iv. 
    any damage to property, accidents or injuries incurred at the Event or part thereof. 
    v. 
    financial or other responsibility for: 1) any loss or liability incurred by the public at the Show, which arises or may arise as a result of contracts entered into by visitors with any exhibitor or for any advice sought or obtained from any exhibitor; or 2) any loss or damage to personal property brought into the Show. 
    vi.
    any indirect, special or consequential losses, including, but not limited to: i) loss of profits; ii) loss of revenue; iii) loss of contracts; iv) loss of data; or ) loss of goodwill. 
  28. The Organiser’s liability (whether in contract, tort (including negligence) or otherwise) is limited to the purchase price of the tickets that a visitor purchased, or £50 (whichever is the greater). 
     

    Entire Agreement
  29. These terms and conditions contained in clauses 1 to 54 constitute the entire agreement between the Organiser and any visitor and neither party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these terms and conditions which is not already set out in these terms and conditions. This clause shall not limit or exclude the Organiser’s liability for fraud or fraudulent misrepresentation. 
  30. If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms and conditions. 

    Governing Law & Jurisdiction
  31. These terms and conditions and the purchase of any ticket to any part of the Event and shall be governed by the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction to the English courts.  

    Prize draw -  Bring a friend to the Digital Networking Event to be in for the chance to win a £50 Amazon voucher. 
  32. The prize is 1 x £50 Amazon gift card (the “Prize”).  
  33. Entries will be accepted from 12pm on 16th February 2021 until 10am on 23rd February 2021. 
  34. The promoter of this competition is British Marine Federation, company number 2592536, with its registered office at Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF (the "Promoter"). 
  35. Enter by registering for the event on Eventbrite using a valid e-mail address. The main entrant and guest must register at the same time. 
  36. Entry is open to UK residents aged 18 or over, except the employees and family members of the Promoter or those of its group companies. 
  37. No entrant can select an alternative prize. The Promoter reserves the right to substitute any Prize with an alternative prize of equal or greater value or to offer a cash alternative. 
  38. Entry is limited to one entry per email address. 
  39. The Promoter will be in no way liable for any failure or inability to contact any entrant via the entrant’s email address given during the entry, or for any other circumstances beyond the reasonable control of the Promoter or otherwise.  
  40. The draws to determine the winners of the competition will take place on or around Wednesday 24th February 2021. The winner will be selected at random. The selection of the winner will be final, and no correspondence will be entered into by the Promoter in respect of any decision made. If a winner does not confirm acceptance within 24 hours, or cannot be contacted, the Prize (as applicable) will revert to the next newly drawn email (who has not already won a Prize) and so on. If a winner wishes to reject the Prize (as applicable) in favour of giving it back to the Promoter to re-raffle or auction, he/she may do so. 
  41. Regardless of whether the Promoter has been successfully able to contact a winner, a winner must communicate to the Promoter his/her acceptance of the Prize to the Promoter within 24 hours of being contacted via email by the promoter. If the winner fails to do so, the Prize will be forfeited and will revert to the next drawn entry under clause 42.  
  42. The Promoter shall be entitled to delay the draw at any time. 
  43. By taking part in the prize draw, entrants agree to participate in publicity at the Promoter’s request if they are a winner of the prize draw. Winner agrees that the Promoter (or any third party nominated by the Promoter) may in its sole discretion use their (and if applicable their companion's) name (which shall be provided by the winner(s) on request) and image and their comments relating to the Prize and their experience in perpetuity for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid. 
  44. The Winner of the competition agrees that the Promoter may list their names on such mediums as the Promoter determines in its sole discretion. The winner further agrees that their name will be made available to any individual requesting the name of the winning entrant.  
  45. All personal data provided by entrants to the Promoter in connection with a competition entry will be used by the Promoter, its employees, suppliers, contractors and agents to process the competition, and (if applicable) to inform them of their winning entry and to distribute the Prize (as applicable).  
  46. The name of the winner is available on request to the Promoter, enclosing a stamped self-addressed envelope, directed to: Participation Survey Competition, Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF.  
  47. The Promoter accepts no liability for errors or omissions contained within the Prize details. It is the responsibility of the winner to satisfy him/herself as to the accuracy of any such details. 
  48. The Promoter reserves the right: 1) to disqualify any persons whose conduct is contrary to the spirit of the rules or the intention of the competition and to declare as void any or all claims or entries resulting from any printing or production errors; 2) to add or to waive any rules on reasonable notice; and 3) to cancel the competition at any stage in the event of circumstances beyond its reasonable control. 
  49. Once a winner has accepted the Prize the Promoter will arrange for Prize, to be sent to the winner via the email provided upon entering the competition. 
  50. Each Amazon gift card is subject to the additional terms and conditions of Amazon EU S.à r.l.  
  51. If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms and conditions.  
  52. The Promoter shall not be liable to any winner in respect of any losses, costs, expenses incurred as a result of the Promoter’s inability to make the Prize available.  
  53. The Promoter shall not be liable for any costs, losses or expenses incurred by an entrant in connection with this competition, unless required by law.
