Published on: 22 November 2018Following questions on Retention of Title, British Marine have drawn up the following document that members can use in their Terms and Conditions. The purpose of the Retention of Title clause (ROT Clause) in a sale of goods contract is to seek to ensure that the buyer does not acquire title (ownership) to the goods until they have been fully paid for. If the goods are not fully paid for, for any reason such as insolvency, the seller should be able to reclaim the goods as well as priority over other creditors in respect to those goods.
